Questionnaire and Forms 

If you wish to be appointed Deputy for the property and financial affairs of a person who has lost mental capacity, then you must make an application to the Court of Protection.

1. Information Questionnaire 
 

This document contains the information that we need in order to complete a Court of Protection Deputyship application on your behalf. It must be printed, completed and can be returned by email to: info@qualia-law.org

or by post to Qualia Law CIC, 39 Bessborough Drive, Cardiff, CF11 8NE. 

2. COP3 Mental Capacity Assessment Form  
 

A mental capacity assessment must be completed by a suitably qualified professional on a COP3 form (which can be downloaded here). The incapacitated person's details must be added to section A and the person carrying out the assessment must complete and sign Section B. 

3. COP4 Declaration Form   
 

Any proposed Deputy must provide legal undertaking to confirm the responsibilities and obligations they will be taking on. The COP4 form, which can be downloaded here, sets out a number of undertakings which any proposed Deputy must make. 

We always advise that any proposed Deputy should also consider the Office of the Public Guardian's guidance on acting as a Deputy in order to ensure the applicant (proposed Deputy) is fully aware of the role and responsibilities before the application is submitted.
