Supporting financial independence now, with safeguards for the future

Two people going through a document together at the table

A lasting power of attorney is a legal document that allows an individual to appoint one or more people to make decisions on their behalf during their lifetime. These people are known as Attorneys.

There are two types of LPA. One allows Attorneys to make decisions about health and care and the other allows Attorneys to make financial decisions.

We specialise in the latter, and can act as an independent professional Attorney for property and finance matters, providing expert support while helping individuals maintain as much control and independence as possible.

Why appoint a professional Attorney?

For many people, appointing a professional attorney can be an effective early-planning measure. An LPA can provide peace of mind, ensuring that decisions are made by a trusted person with the individual’s best interest in mind. Should capacity be lost in future, an LPA can avoid the need for a Court of Protection application.

Unlike deputyship, an LPA allows support to be put in place without Court involvement, whilst still operating within a clear legal framework regulated by the Office of the Public Guardian.

Appointing an independent professional attorney offers:

  • Expert management

Expertly managed financial and property affairs

  • Independence

Independent management from existing or potential family conflict or influence

  • Continuity

    Continuity and long-term stability

  • Accountability

    Clear accountability and professional standards

  • Protection

Protection where there are concerns about vulnerability or financial risk

Who might benefit from a professional Attorney?

A professional attorney may be appropriate where an individual:

  1. Is physically unable to manage their affairs independently

  2. Has no suitable family member or trusted person to act

  3. Wishes to plan ahead for future vulnerability

  4. Has a progressive condition or fluctuating capacity

  5. Requires independent and impartial financial management

  6. Has complex financial affairs or safeguarding concerns

  7. Prefers not to place responsibility on family members or friends

Lasting Power of Attorney

“I completed my parent’s LPA forms and it was a nightmare, worrying about whether I’d made mistakes, so for my own, I was relieved to pass the responsibility to Qualia! … Qualia took away all my worries and concerns, making it a simple operation completed with professionalism and sensitivity. Thank you, Tom and your amazing team!”

She was very happy with the support she received.”
